Race Track negligence
The Plaintiff was a 47-year old female who was a spectator at a go cart race. She was sitting behind the fence constructed by the racetrack when a racing go cart came through the fence striking the Plaintiff in the head. The Plaintiff was flown to the hospital and found to have a significant closed head injury resulting in memory loss, change of voice accent, loss of fearfulness. The Plaintiffs claimed that the racetrack was negligent in failing to install proper barriers along the outside of the racetrack, including failure to install hay bales, rubber matting tires or other devices that would prevent racing vehicles from entering the spectator area and the pits. Defendants claimed that the Plaintiff signed a release and assumed the risk of any injury. The Plaintiffs were able to successfully defeat this motion which resulted in a settlement for the Plaintiff.
