Tractor trailer negligence
The Plaintiff, Dencil Smith, was called by Tony’s Wrecker Service to repair the brakes of a tractor trailer. The tractor trailer was placed out of adjustment by the Tennessee Department of Safety on Interstate 40 near Exit 23 at the weigh station. The Plaintiff had to be under the tractor trailer to make the repair. The driver of the truck, without warning to the Plaintiff, started the truck in gear running over the Plaintiff’s legs. The Plaintiff sustained a fracture to his ankle with soft tissue swelling. Plaintiff incurred $35,099.22 in medical expenses. Plaintiff discovered the Defendant destroyed logbooks and violated other Federal Motor Carrier Safety Regulations.
